By using the website www.swisslymo.ch (the Website), or Swiss Lymo Rider/Driver (the Application), you agree to these Terms and Conditions of Use (Terms & Conditions).

Access to Website and Profile Database: Swiss Lymo is a platform which offers services, business & innovation management advice and promotion services to all users Clients/Drivers. The following terms and conditions apply to all access to and use of our website including the profile database and any associated content that is available via direct access from this platform. Use of our Website and/or Database constitutes your agreement to abide by the terms and conditions below, as amended from time to time.

Disclaimer: Swiss Lymo assumes no responsibility for the content, accuracy, timeliness, reliability, or completeness of the information displayed, or through misuse of the connection or technical faults are fully excluded.

In accordance with our general terms and your consent when accepting these terms, it is important to note that SwissLymo is a virtual platform designed to connect passengers with drivers. From a legal standpoint, we wish to inform you that SwissLymo disclaims all liability for any event, regardless of its nature, occurring before, during, or after a trip facilitated through our platform.

We encourage you to review our general terms for more information regarding the responsibilities and obligations of each party.

Liability for links: References and links to third-party websites are outside Swiss Lymo’s area of responsibility and we reject any responsibility for such websites. The access and use of such websites are entirely at the user’s own risk.

You are not permitted to create links to our platform from any other website without first obtaining our written permission.

Copyright: Copyright and all other rights to content, images, photos or other files on the website belong exclusively to Swiss Lymo, its stakeholders, partner organisations or the expressly named rights holders. For the reproduction of any elements, the copyright holder’s prior written consent must be obtained.

Service access:While we endeavour to ensure that our site/application are normally available 24 hours a day, we shall not be liable if for any reason our site is unavailable at any time or for any period. Access to our site/application may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control. In such a situation we will endeavour to restore full system services as soon as possible.

Acceptable Use Policy

You may use our site only for lawful purposes.

You may not use our site:

In any way that breaches any applicable local, national or international law or regulation.

In any way that is wilfully unlawful or fraudulent or has any unlawful or fraudulent purpose or effect.

To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam), either to us, to anyone whose details are posted on our site or to anyone whose contact details you later acquire through our partner-matching services.

You also agree:

Not to reproduce, duplicate, copy or re-sell any part of our site in contravention of the provisions of these terms of website use.

Not to send automated queries of any sort via our site without express permission in advance from us. Automatic queries include attempts to harvest company email or website addresses by means of spamming bots or spiders.

In the case of any legal dispute, Swiss law shall be applied, regardless of the jurisdiction where you are based. By using our website/application or database you irrevocably agree that Swiss courts shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these terms of use and you agree to submit irrevocably to the decisions reached under Swiss law. Any legal proceedings shall take place in Geneva, Switzerland.

Passengers and Drivers Cancellation

All abusive cancellations and not respecting the passenger’s time deactivate you from the platform, as well it is applicable  for the cancellation of a reservation taken and confirmed with the customer, you have only 3 minutes, either you keep it and assume the trip or cancel it before the 3 minutes.

All cancellations are paid after three minutes that the driver moves towards the passenger. The costs are, depending on the time that the driver has spent, and the kilometers driven.

Any waiting time, passenger pays CHF0.50 per minutes

Cancellation fees will be applied if you cancel the trip after the end of the timer.

The total fare will exclude toll tax and may change if your journey takes longer due to traffic or other factors. If you cancel after 3 minutes the driver has accepted the ride, a cancellation fee will apply.

Before accepting rides, you have enough time to read the information and details about the ride, when the driver accepts a ride, a contract is established, otherwise the cancellation is fraud and abusive.  

Insurance & Security

“Accept the terms of use and the privacy policy” : “By clicking on “Sign up”, you accept the terms of use and the privacy policy of SwissLymo. You consent to receive telephone calls and SMS or WhatsApp messages etc. from SwissLymo to provide updates on your order and/or for marketing purposes. The frequency of messages depends on your activity. You can unsubscribe by sending \STOP\ or modifying notifications in your app. Message and data rates may apply.

“documents authentication” : “I accept that documents uploaded by me are true and correct. I understand that any attempt of providing incorrect, misleading information or fake documents will lead to my immediate black listing from the SwissLymo  platform. SwissLymo platform reserves the right to take the matter to the law enforcement authorities in case of forged documents.” 

The platform has been designed with security measures to restrict access to document downloads by employees and even the admin of SwissLymo. Legally, the responsibility for these documents and their information lies entirely with the drivers. Therefore, you are required to download the documents yourself.

Before an account deactivation due to outdated documents or an expired deadline, our system sends notifications in two stages. First, a reminder is issued 30 days before the deadline, followed by a second reminder 15 days before the expiration. These notifications are strategically designed to provide drivers with ample time to submit the necessary documents.

If you have already submitted these documents at the beginning of your activity and continue to receive requests, it may be due to an expiration date or a required update. We strongly encourage you to try uploading the requested documents again. If the issue persists, feel free to contact us directly so that we can promptly resolve this situation.

It is crucial that drivers keep their information up to date in accordance with our requirements to ensure the safety and compliance of our community.

“Insurance” :  SwissLymo is a  working  tool that declines  any responsibility for any   kind of insurance (vehicle and passengers) is directly the reasonability of each party. SwissLymo declines any kind of insurance and very clearly decline any responsibilities towards any party (Vehicle & Passengers) Users (Drivers & Passengers) agree to the general conditions before using the SwissLymo applications.

Privacy policy

Based on Article 13 of Switzerland’s Federal Constitution and the provisions of Swiss data protection laws (Federal Act on Data Protection of 19 June 1992, FADP, and Ordinance to the Federal Act on Data Protection of 14 June 1993), everyone is entitled to privacy and protection from misuse of their personal data. Swiss Lymo complies with these provisions. Personal data is kept strictly confidential and is not sold or passed on to any third party unless we have your express permission.

With other users

We share certain user information to enable the planning and provision of rides. This includes sharing:

Passenger information shared with the driver includes name and photo, rating, pick-up and drop-off locations, number of rides, offered fare, comments, and contact details.

Driver information shared with Rider includes name and photo, vehicle information and photo, location before and during trip, ratings and reviews, number of trips, contact details.

We may also be required to provide passengers with receipts and invoices containing information such as the origin and destination of the journey, the total duration and distance of the journey, details of the total price, the name of the driver and the number tax ID. We also include other information on these receipts if required by law.

For the purposes of other services, we will share with other users the information needed to plan and provide those services.
